Mathew questions the Government of Aruba and its Parliament as to why they are NOT investigating the injustices done by the Judges and Prosecutors in Aruba.

Thru the media and various other channels, several members of the Appeal Courts have brought forward the countless wrongful and corrupt acts committed  by these members of Aruba’s Judicial and Justice system, but to date nothing has been done to address this grave problem. 

In particular several complaints have been made against the Aruban Judge of Instructions Judge Yarzagaray, yet it seems that all of these complaints have fallen on deaf ears. In the case of Foxy Lady, a case that from the very beginning has been plagued with corruption and driven by personal agendas, this continued corruption by this very same Judge is painfully evident.

Judge Yarzagaray has refused the defense in the Foxy Lady case even their most basic human rights by:

1.       Refusing  to start the questioning of witnesses by the defense

2.       Refusing to allow the defendants to be present for the questioning of their own witnesses

3.       Refusing the defendants an interpreter during the witness interrogation at the cost of the court despite the fact that this is an obligation of the courts by treaty in all penal cases

4.       Refusing the defendants more than 45 minutes to question the witnesses which is an  unreasonably limited time frame

5.       Conducting an interrogation of the defense’s witness without the defendants or their Attorney present

6.       Stopping the court session to talk a witness outside of courts during a break

7.       Going as far as taking a witness that was under oath out of her sworn obligations to the court (taking the witness out of oath) when the witness was lying

8.       Instructing a witness on what to answer to a specific question posed by the defense’s Attorney

9.       Refusing to continue with the interrogation of the a crown witness after the witness repeatedly lied in court

1.   Ordering a Dutch Attorney to question witnesses in English while the Attorney clearly stated that he is unable to properly conduct the cross-examination of anyone in the English language

Thus in light of all the above, the real question then becomes is Judge Yarzagaray just discriminating against black/colored people in general? OR Is this Judge just simply not fit to be a real Judge, since rumors state that her superiors in Holland banned her from becoming a real Judge?  Given the importance of this matter I ask the Government and Parliament of Aruba to investigate this ongoing pattern of corruption taking place within its Judicial and Justice system and to look into all of the above mentioned acts committed by Judge Yarzagaray, so that Justice in Aruba can be restored and prevail for one and all.
